CAW TERMS AND CONDITIONS

Access to and use of this site is provided by Competence at Work Limited (CAW) subject to the following terms and conditions:

1. Use of this site constitutes your acceptance of these terms and conditions which take effect at the time you first access the site.

2. If you do not accept these terms and conditions you must not use this site.

3. CAW reserves the right to change these terms and conditions at any time by posting changes online. It is your responsibility to refer to these terms and conditions on accessing this site.

4. Continued use of this site after such changes to the terms and conditions constitutes acceptance of those posted changes.

5. CAW reserves the right to make this site unavailable at any time or to restrict access to parts or all of the site without notice.

6. You acknowledge that all intellectual property rights, including any trade marks or copyright in the content of this site, are owned by CAW or its third party suppliers. Nothing contained herein shall be construed as granting any licence or right to use any of the intellectual property of CAW except as otherwise provided on this site.

7. You agree to use this site only for lawful purposes and in a manner which does not infringe the rights of, or restrict or inhibit the use of or enjoyment of this site by any third party.

8. If you choose to Register on this site, you will be asked to enter a username and password ("Log-in details"). You are responsible for maintaining the confidentiality of these Log-in details and must not allow anyone else to use these Log-in details. You must immediately inform CAW of any unauthorised use of your Log-in details. This can be done by emailing post@cawuk.com

9. CAW reserves the right to suspend or terminate your access to this site and/or Log-in details at its sole discretion and without notice.

10. You agree to indemnify, hold harmless and defend CAW from any and all loss, damage and expense (including legal fees) incurred by CAW on account of any claim or lawsuit arising out of or related to your use of this site or material posted on this site under your Log-in details, whether or not authorised by you.

11. You accept that when you leave this site (whether knowingly or not) CAW can no longer be responsible in any way for any material that you encounter and CAW excludes (to the fullest extent permitted by law) any liability that may arise with respect to or as a result of such material causing any damage, costs, injury or financial loss of any kind.

12. CAW uses reasonable care and skill in providing the content on this site but does not represent or warrant the accuracy, timeliness, completeness or suitability of the content.

13. These terms and conditions are governed by and will be interpreted in accordance with English law and the parties submit to the exclusive jurisdiction of the English courts.

14. CAW does not warrant that this site is free of viruses or bugs or that this site is compatible with all computer systems and browsers.

15. This site includes links to other sites on the world wide web. CAW makes no warranties as to the suitability or accuracy of the content of any of those sites.

16. CAW accepts no liability for any product or service advertised, supplied or otherwise promoted on this site by any third party. CAW also disclaims liability for any downloadable software on this site.

17. CAW is happy to accept comments, stories or other submissions from its users. CAW is under no obligation to publish any such material and such material shall be considered to be the property of CAW. CAW may dispose of such material at its discretion.

PRIVACY POLICY

Respecting the privacy of our customers and ensuring the confidentiality of customer information is critical to Competence at Work Limited (CAW). The purpose of this Privacy Policy is to ensure that we interact with all of our customers in line with current legislation such as the Data Protection Act 1998 and in accordance with their wishes.

1. CAW will use your contact details (postal address, email address, telephone, mobile and fax numbers) to contact you regarding the product and/or services you have requested. This includes re-registration/renewal notifications, surveys on improving our service to you, promotions, discounts and/or updates regarding the product and/or service you have requested.

2. CAW offers you the chance to opt in to receive additional information from CAW by email, telephone and/or fax. This includes other products/services that CAW offer and that CAW feels will be of interest to you.

3. CAW offers you the chance to opt out of receiving additional information from CAW by post. This includes all other products/services that CAW offer.

4. At all times a recipient of a CAW product and/or service will have the opportunity to amend their contact details and/or to opt in or out of any of the options listed above. You can also request, at any time, to have your personal details flagged on the CAW database to ensure you do not continue to receive such information. We will not actually delete your record from the CAW database as we would no longer be able to identify you, which could lead to you receiving information from us in the future. To action any of these requests please contact us either by post, phone or fax.

5. You have the right to be told what personal information we hold about you on our database. You should write to Ms Shannon Davies, Competence at Work, Omnia One, Queen Street, Sheffield, S1 2DU. In your letter you must state your full name, your address and all publications and/or services from CAW to which you know you subscribe. A small administration charge of £5.00 will be made for fulfilling this request.

6. CAW may make anonymous use of information to help diagnose faults, manage the system and gather broad demographic information about our users in general. This information will be stripped of all details that could identify you personally. For example, we may use IP addresses to help fix performance problems with our server.

7. CAW uses all reasonable precautions to keep the personal information disclosed to it secure.

8. CAW is not responsible for the content or the privacy policies of third party web sites linked to this site.

9. CAW reserves the right to change this privacy policy at any time by posting changes on this page. It is your responsibility to refer to this privacy policy on accessing this site. CAW will however draw your attention to any material changes to this privacy policy by placing a notice on the site.

TERMS AND CONDITIONS FOR SALE OF TRAINING COURSES

1. BOOKING AND PAYMENT

1.1.  All bookings are provisional until full payment has been received and processed by Competence at Work (CAW).

1.2.  Provisional Bookings will be held for 14 days. CAW reserve the right to allocate provisional bookings to other customers after this time.

1.3.  Bookings must be made through the Order Booking Process on the CAW website. All bookings are subject to availability.

1.4.  Full payment must be received and processed before the start of the course.

1.5.  CAW will except valid payment in the form of cheques, credit or debit cards. All cheques received but are not honoured by the bank will incur a £25 administration fee.

1.6.  Bookings and cancellations will be confirmed, by email, within 48 hours of receipt.

2.  FEES

2.1.  The price shall be that quoted in Competence at Work’s (CAW) current paper or electronic price lists, or such other price as we may agree in writing, subject to confirmation at the time of order and are exclusive of VAT. VAT will be charged in accordance with legislation current at the date of supply.

2.2.  The course fee will include, unless otherwise stated, training, handouts and delegate packs, along with lunch and refreshments.

2.3.  All course fees are payable in advance of course commencement.

3.  CANCELLATIONS

Any cancellation made by the delegate 1 calendar month or less in whole or part prior to the scheduled date of the course will incur the following charges:

For the purpose of these conditions the expression “confirmed charges” means the charges specified by CAW to the delegate in the contract in relation to the particular event.

4. CANCELLATION BY COMPETENCE AT WORK

4.1.  CAW shall have the right at any time (giving as much notice as possible to the client) to cancel the booking in the event that: -

4.1.1. The venue or any part thereof is closed due to circumstances outside their control.

4.1.2. The Delegate has failed to pay in full the required amount.

4.2. If the booking is cancelled by CAW any money paid by the delegate will be returned but in the case of circumstance under 4.1.2, a deduction will be made to cover administration and venue charges.

5. TRANSFERS & RESCHEDULING

5.1. Applications to transfer or reschedule delegates from one course to another will be treated as a cancellation and as such rules for cancellation will apply.

6. COURSE CHANGES

6.1. CAW reserves the right to improve the specification and format of its course for the benefits of its delegates without notice to the delegate, providing it does not change the aim and objectives of the course.

6.2. The location and date of the course will be as advised to the delegate at the time of booking. CAW reserves the right to change the location of the course and will advise the delegate as soon as the change is known.

6.3 CAW reserves the right to cancel or reschedule any course if the number of delegates booked is too few to ensure the successful completion of the course.

7. EXPENSES

7.1. The delegate is responsible for their own travel to and from the course location and any accommodation required.

8. LIABILITY

8.1. CAW’s sole liability in respect of the provision of any training course, is to carry out the training programme which CAW has laid down for the duration of the course. CAW gives no guarantee that a delegate will reach any particular standard as a result of attending the course.

9. FORMAL COMPLAINTS PROCEDURE

9.1. Any complaints arising from CAW’s services should immediately be brought to the attention of a member of CAW staff, in order that an early mutually agreeable resolution may be found.

9.2. CAW will agree to investigate the matter fully, requesting further information and will then refer the case to Higher Management with recommendations, for consideration and final decision.

9.3. Once a decision has been reached, a written response, setting out a detailed explanation will be sent to the complainant.
